This suit arose as a result of the Texas Department of Human Services's (DHS), removal of Amy Reck (Amy), a fifteen year old, from the home of her mother/guardian, Gwen Reck (Gwen) and stepfather, Kenneth Erwin (Erwin). Amy had made allegations of sexual molestation against Erwin. Initially Gwen did not believe the allegations and refused to require Erwin to leave the home.
