The appellant, Henry Burton, pleaded guilty on November 14, 1994, to the murder of Cheryl Smith. Following a sentencing hearing on December 2, 1994, the appellant was sentenced to 65 years' imprisonment, and was ordered to pay a crime victims compensation fund assessment of $5,000 and to make restitution in the amount of $5,283.
