This is a workers' compensation case tried under the new Texas Workers' Compensation Act, TEX.LAB.CODE ANN. §§ 401.001 et seq. (Vernon Pamph.1995). The Texas Workers' Compensation Appeals Panel determined that appellee, Billy Carl Johnson, sustained an injury in the course and scope of his employment.
