The appellant, Jimmie Randall Childs, was convicted of unlawful possession of marijuana in the first degree, a violation of § 13A-12-213, Code of Alabama 1975. He was sentenced to five years in the penitentiary.

The state's evidence tended to show that on February 10, 1994, the appellant possessed 1.72 grams of marijuana and that he had previously been convicted of unlawful possession of marijuana for personal use. Officer Kenny...
