This tort claim by plaintiff, James Moffett, and against Buck Kriehs Company, Inc., was dismissed by summary judgment. The trial court found that plaintiff's injury occurred while he was engaged in his duties as the statutory employee of Kriehs pursuant to LSA-R.S. 23:1061 with the result that Kriehs was immune to the tort suit.
