Charles Herriman filed suit against relator, The Atchison, Topeka, and Santa Fe Railway Company (Santa Fe), seeking damages under the Federal Employers' Liability Act, 45 U.S.C. §§ 51-60, for personal injuries suffered while working for Santa Fe.
