This is an appeal by respondent, Homer L. Foote, Jr., from a judgment of the circuit court ousting him from the office of Sheriff of Cass County. At the time of the proceedings, Foote was in his third term of office, having first been elected in 1984, and reelected in 1988 and 1992.
