The Department of Corrections (the DOC) appeals a summary judgment order restraining it from performing a deoxyribonucleic acid (DNA) analysis on inmate Sheryl D. Kelley's blood. The DOC contends that certain statutes transform Kelley's unclassified possessory drug crime into a class A violent felony, making her blood subject to DNA testing under RCW 43.43.754 (the DNA statute).
