I. INTRODUCTION

Appellant in this case was charged with assault in the first degree. Appellant was tried twice, the first trial resulting in a hung jury and the second in a conviction. Appellant failed to appear at sentencing and was arrested 14 years after the conclusion of the second trial and sentenced to a term of imprisonment.
