BRYNER, Chief Judge.

Juan K. Espinoza pled no contest to one count of third-degree assault, AS 11.41.220(a)(1). In return for his plea, the state agreed to recommend a sentencing cap of one year's unsuspended incarceration and to dismiss the original charge of attempted second-degree murder.
