I. FACTUAL AND PROCEDURAL BACKGROUND

Either late in the evening of May 15 or early May 16, 1992, B.K. was sexually assaulted and murdered. The state charged Stephen J. Harmon with sexual assault in the first degree and murder in the first degree after the results of DNA testing connected him with the crime.
