OPINION

STATON, Judge.

Hosie Moore ("Moore") appeals from the denial of his petition for post-conviction relief. In his appeal, he presents two issues for our review which we restate as follows:

I. Whether the trial court committed fundamental error in instructing the jury. II. Whether he was denied the effective assistance of counsel.

We affirm.
