In April 1991, appellees James O. Clark and Genevie Clark (the "Clarks") sued appellant Kerrville State Hospital ("Kerrville") and the Texas Department of Mental Health and Mental Retardation ("Department") in Travis County for the wrongful death of their daughter, Rebecca Clark Ligon.
