O'BRIEN, Justice.

The appellant was indicted by the Hamilton County Grand Jury for the first degree murder of James Logan. Count one of the indictment charged an unlawful, intentional, deliberate and premeditated killing. Count two charged a reckless killing committed in the perpetration of, or attempt to perpetrate, a robbery.
