YAÑEZ, Justice.

Appellant, Edward Anthony Morales, appeals from a conviction for capital murder. Before trial the State filed notice that it would not seek the death penalty, and appellant plead not guilty. After a jury trial appellant was found guilty, and punishment was automatically set at life imprisonment. In two related points of error, appellant argues that his conviction should be reversed.
