EAGLES, Judge.
Plaintiff assigns as error the trial court's denial of plaintiff's motion for summary judgment and the trial court's granting of defendants' motion for summary judgment. Summary judgment is appropriate when the moving party can "establish the lack of any triable issue by showing that no genuine issue of material fact exists and that the moving party is entitled to judgment as a matter of law."
