FEIKENS, District Judge.

I. Introduction

Before me is plaintiff's motion to remand. I hold that Michigan Compiled Laws (M.C.L.) § 418.821 is not preempted by 29 U.S.C. § 1144 and therefore, plaintiff's motion to remand is granted.
