This matter is before the Court on the motion of the defendant Valerie A. Burhans to dismiss this action pursuant to Federal Rule of Civil Procedure 12 and on the motion of the plaintiffs Merrill Lynch, Pierce, Fenner & Smith, Inc. and James MacLachlan for preliminary injunction pursuant to Federal Rule of Civil Procedure 65.
