MEMORANDUM OPINION AND ORDER

HANNAH, District Judge.

Pending before the court are two motions for summary judgment filed by Defendants DPC Industries, Inc. and Terry Lee Pierce. Plaintiff, John E. McCray, filed this employment discrimination suit against Defendants under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e, et seq., and section 1981 of the Civil Rights Act of 1866, 42 U.S.C. § 1981.1
