Defendant, Nathaniel Smith, was charged with possession of cocaine with the intent to distribute in violation of La.R.S. 40:967(A)(1). Defendant entered a plea of not guilty and filed a Motion to Suppress any "alleged controlled dangerous substance which the state seeks to introduce as evidence ... because it was seized without a warrant and in violation of defendant's rights...."
