Before the court is defendant Marvin T. Runyon's (hereafter "Postmaster Runyon") motion for summary judgment filed June 26, 1995. Postmaster Runyon contemporaneously filed a brief and tendered evidence in support of his motion. The plaintiff, Franklin Lamb (hereafter "Mr. Lamb"), responded in opposition on September 11, 1995.
