This is an appeal from an order granting a new trial to plaintiffs, Mary L. Clark, and Emmett Clark, on the issue of damages only. The jury had returned a unanimous verdict for $41,083.33 in favor of the Clark's in a suit in which the Clarks had sued defendant, James H. Bearden, M.D., for malpractice. The Clarks had sued for more than $900,000.
