This case came before the Supreme Court on the appeal of the defendant, Thomas C. Johnson, from a conviction of first-degree murder. On appeal the defendant has raised five issues, challenging (1) the probable cause for his arrest, (2) the trial justice's comments during the defense's cross-examination of the defendant's son, (3) the failure to instruct the jury on voluntary manslaughter and diminished
