White alleges that, by not rehiring him, Stackhouse discriminated against him in violation of the Americans with Disabilities Act, 42 U.S.C. § 12101, et seq., ("ADA"). On either April 22, 1994 or May 6, 1994, White filed a charge with the Equal Employment Opportunity Commission ("EEOC"). On October 29, 1994, the EEOC issued him a right to sue letter.
