The defendant, James Arthur Carney, was convicted after a jury trial of the second degree murder of his ten-week-old daughter, a violation of LSA-R.S. 14:30.1. He was sentenced to serve a mandatory sentence of life imprisonment without benefit of parole, probation or suspension of sentence. After he was granted an out-of-time appeal, we reversed and remanded for further proceedings. On rehearing, we conditionally vacated our first opinion and remanded...
