Presently before the Court is a "Motion to Remand" filed by Tennessee Gas Pipeline Co. The Magistrate Judge has previously filed a Report and Recommendation recommending the motion be granted. For the following reasons this Court denies the motion. However, because this denial rests upon a close question of law, this court will grant the parties the option to pursue an interlocutory appeal to the Fifth Circuit...
