The order of the Appellate Division should be affirmed.

After a jury trial, defendant was convicted of two counts of rape in the first degree and sexual abuse in the first degree for his encounter with the then nine-year-old daughter of the woman with whom defendant lived. Defendant moved to vacate his conviction pursuant to CPL 440.10 on the ground that he was denied effective assistance of counsel....
