Defendant-appellant John M. Stembridge appeals a partial summary judgment on liability in favor of plaintiff-appellee Mark M. Mintz. We reverse.

In 1980 Stembridge was the plaintiff in an action against his insurance company following a fire in a building owned by Stembridge (the "Insurance Action"). Mark J.
