This case is before this Court upon an appeal from the final order of the Circuit Court of Pocahontas County, West Virginia, entered on September 21, 1994. Pursuant to that order, the appellant, Jane Lee Davis, was adjudged guilty, following trial, of first offense driving under the influence of alcohol, a misdemeanor. W.Va.Code, 17C-5-2 [1994]. The appellant was sentenced to confinement in jail for 24 hours and fined $150.00, plus costs. At issue...
