I. FACTUAL AND PROCEDURAL BACKGROUND

This is a habeas corpus case. In September, 1985, Sherman Carter was charged by indictment with trafficking in heroin, possession of cocaine with intent to distribute, and possession of marijuana. On October 6, 1986, Carter pled guilty under a plea agreement with the prosecution.
