Pending before the court is Defendants' Motion to Dismiss (doc #18) which was converted to a motion for summary judgment by the Honorable William Wayne Justice. The case was then transferred to this court. The court finds that Defendants' motion regarding the Section 1983 claim has merit and should be granted. Plaintiff's remaining state law claims are dismissed without prejudice.
