Clortis Foston Roberts, appellee, was charged with misappropriation of fiduciary property. Tex. Penal Code Ann. § 32.45 (Vernon Supp.1994).1 She filed a pretrial motion to suppress a deposition taken in an earlier civil action which the state proposed to use in the criminal prosecution.
