OPINION

McCLURE, Justice.

Pursuant to Article 44.01 of the Texas Code of Criminal Procedure, the State of Texas1 appeals from an appellate decision of the County Court of Midland County reversing the judgment of the City of Midland Municipal Court and directing the entry of a judgment of acquittal. Tex.Code Crim.Proc. Ann. art. 44.01 (Vernon Supp.1995). We reverse.
