The Supreme Court of the United States decided in Helling v. McKinney, 509 U.S. ___, 113 S.Ct. 2475, 125 L.Ed.2d 22 (1993) that an inmate states a cause of action under the U.S. Const. Amend. VIII when he alleges that prison officials have, with deliberate indifference, exposed him to levels of environmental tobacco smoke that pose an unreasonable health risk.
