This matter is before the Court because Brown v. Commissioner [Dec. 45,455(M)], T.C. Memo. 1989-43, filed January 30, 1989, was vacated and remanded by the Court of Appeals for the Ninth Circuit for further consideration of petitioner's ex parte motions for writ of habeas corpus ad testificandum. 902 F.2d 38 (9th Cir. 1990).
