TAYLOR, Judge.

The appellant, Albert Lee Jefferson, was convicted of murder during the course of a robbery, defined as a capital offense in § 13A-5-31(a)(2), Code of Alabama 1975. The jury, by a vote of 11 to 1, recommended that the death penalty be imposed. The trial court accepted the jury's recommendation and sentenced the appellant to death by electrocution. The appellant appealed his conviction to this court and we remanded the case so that a new sentencing...
