This matter is before the court on the Plaintiff's Motion for Summary Judgment and to Dismiss Defendants' Counterclaims, (Doc. 13). The Defendants have failed to respond to this motion pursuant to Local Rule 5, however, because of the serious nature of the motion and the court's ruling, the court will address the issues presented in the Motion.
