I. Introduction

This appeal arises out of appellant Andy Fiala's negligence suit against appellee, Lori Rains, for damages sustained when he was physically beaten by a third person in her home. At the close of Fiala's evidence, the trial court granted Rains's motion for directed verdict and entered judgment in her favor.
