Defendant-Appellant's motion for rehearing is denied. The opinion filed December 22, 1993, is hereby withdrawn, and this opinion is substituted in its place. Defendant was arrested and charged with driving while intoxicated (DWI). Following a bench trial in Bernalillo County Metropolitan Court, Defendant was found guilty of DWI.
