In this case we focus upon the enforceability of an exculpatory clause in an agreement between an investor and a securities investment firm. The clause at issue provides that the investment firm will not be liable for losses to the investor resulting from the firm's negligence, but only for those losses resulting from its gross negligence or wilful misconduct.
