Defendants, David Troy McDaniel and Pamela Louise McDaniel, husband and wife, appeal from their convictions by jury trial of the offense of possession of a controlled substance (marijuana) with intent to deliver. The court of appeals reversed their convictions on the grounds that the district court erred in (1) failing to give an instruction allowing the jury to find that a prosecution witness was an accomplice of defendants and requiring corroboration...
