MARCUS, Justice.*

Defendant was charged by bill of information with the offense of second degree battery. After trial by jury, defendant was found guilty as charged, and was sentenced to serve 60 months at hard labor. Defendant appealed his conviction and sentence. The court of appeal affirmed in an unpublished opinion.
