This cause is on appeal from an order denying Robert T. Avera's petition for writ of habeas corpus. Avera raises two issues: (1) whether the trial court erred in failing to conduct an evidentiary hearing as previously ordered; and (2) whether the amount of basic gain time forfeited was the result of an ex post facto application of law.
