Pursuant to Rule 228, SCACR, we agreed to answer the question certified to this Court by order of Charles K. McCotter, Jr., United States Magistrate for the Western District of North Carolina:
Whether S.C.Code Ann. § 39-3-40 (1985) precludes prosecution by the State of South Carolina of a witness compelled to testify in a civil action brought in the United States District Court under S.C.Code Ann. § 39-3-10 and § 39-3-30.
