Ordered that the judgment is reversed insofar as appealed from, on the law, the order dated November 16, 1992, is vacated to the extent it granted those branches of the plaintiffs' motion which were for summary judgment on their first and second causes of action, those branches of the plaintiffs' motion for summary judgment are denied, the order is amended accordingly, and the matter is remitted...
