After a hearing on the removal of James Jones, Jr. from the Accelerated Rehabilitation Disposition (A.R.D.) Program, a stipulated non-jury trial was conducted where he was found guilty of Driving Under the Influence of Alcohol or Controlled Substance (75 Pa.C.S.A. § 3731). Appellant waived the presentence investigation and agreed to be immediately sentenced to a term of imprisonment of not less than forty-eight hours nor more than two years....
