Jimmy Mote was indicted by a DeKalb County grand jury on six counts of homicide by vehicle, OCGA § 40-6-393 (a), and two counts of driving under the influence of alcohol, OCGA § 40-6-391. The trial court directed a verdict of not guilty as to three counts of homicide by vehicle and one count of DUI, and Mote was convicted by a jury on the remaining counts.
