KAPLAN, J.
In early morning of November 11, 1989, the defendant, Roosevelt Jefferson, shot Lester Miller at point blank range with a .38 calibre handgun. Miller died of the wound almost immediately. Upon jury trial, the defendant was convicted of murder in the second degree and of associated firearms violations. The defendant appeals. We affirm.
