The State of Florida, Department of Environmental Protection, appeals from a nonfinal order granting an emergency injunction to the operators of a waste management facility. For the following reasons, we reverse.

As a consequence of Hurricane Andrew, the Department issued emergency orders allowing certain waste facilities to operate without the customary permits in order to deal with the disaster debris. The United States Army Corps of Engineers...
