Appellant, Fleming Carey, ("Carey") was convicted of second degree murder while armed, D.C.Code §§ 22-2403, -3202 (1989 & 1994 Supp.), carrying a pistol without a license, id. § 22-3204(a) (1994 Supp.), and two counts of malicious destruction of property (misdemeanor), id. § 22-403 (1989 & 1994 Supp.).
